Representative Client Experience
- Represents developers, property owners and insureds of title companies to cure and resolve various issues relating to real estate, including boundary disputes, access problems, mortgages and liens, easements and other impediments on title to real estate.
- Represents title insurance companies in various actions to establish equitable liens to prevent losses arising from closing errors, fraud, or defalcation, and in actions to recover losses arising from claims, and in defending policy claims.
- Represents owners and managers of regional malls, shopping centers and office buildings in eviction actions and collection of rentals from tenants and guarantors, and in the negotiation of leases for those facilities.
- Provides general counsel to an Orlando-based property management company responsible for management of multiple apartment and commercial complexes throughout the United States.
- Represents a national and a statewide banking institution in various lawsuits including those involving check and deposit issues (UCC Articles 3 and 4) and litigation arising from allegations of negligence or intentional torts, and in collection matters arising from operational losses.
- Obtained a dismissal of a $200,000.00+ claim against a national bank which was upheld in two appeals in (Tompkins v. First Union National Bank, 879 So.2d 1282 (Fla. 2005); Tompkins v. First Union National Bank, 833 So.2d 199 (Fla. 5th DCA 2002)).
- Represented a regional homebuilder in a suit for specific performance to force the sale of property to be used for a new subdivision. The suit resulted in a settlement requiring the sale of the property with a reduction in price for unfinished infrastructure.
- Lead counsel for small business owner who sued its insurance carrier for failing to pay a casualty loss. Obtained jury verdict against insurance company for the full amount demanded, and a court award of fees and costs.
