Governor DeSantis Signs COVID-19 Liability Protection Bill

On Monday, March 29, 2021, Governor Ron DeSantis signed into law Senate Bill 72. The new law greatly increases a plaintiff’s burden in both pleading and ultimately prevailing in a case seeking damages from a business with the central theory being the plaintiff’s contraction of COVID-19 at the business.
From a practical standpoint, unless a case is already pending, meeting the new law’s standards will be all-but impossible for a plaintiff.
