Florida DBPR Issues Amended Order Regarding On-Premises Alcohol Consumption in Bars and Restaurants

On July 1, 2020, the Florida Department of Business and Professional Regulation issued Amended Emergency Order 2020-09 to provide additional detail about when, and under what circumstances, vendors may sell alcoholic beverages for on-premises consumption. The Amended Order provided the following details:
- Vendors not licensed to offer food service shall suspend sales of alcoholic beverages for on-premises consumption;
- Vendors licensed to offer food service may continue to operate as restaurants by:
- Limiting indoor guest capacity to 50% of seating capacity;
- Serving food and beverages for on-premises consumption only to seated guests;
- Screening employees for COVID-19 (as set forth in EO 2020-68)
- Vendors licensed to sell alcoholic beverages for consumption on premises may continue to sell alcoholic beverages for consumption off the premises in accordance with EO 20-71, Sections 1 & 2; and
- The Amended Order does not permit nightclubs to operate.
