Orange County Commissioners Vote to Appeal Temporary Injunction Enjoining Enforcement and Implementation of Rent Control Ordinance
On November 4, 2022, the Orange County Circuit Court entered an order granting Florida Association of Realtors and Florida Apartment Association a temporary injunction enjoining Orange County’s rent control ordinance, which was approved by residents on November 8, 2022. The temporary injunction was entered after the Fifth District Court of Appeals reversed the Circuit Court’s initial denial of the motion.
Today, the Orange County Board of County Commissioners voted to appeal the Circuit Court’s Order. As a result of this vote, the rent control ordinance will once again be scrutinized by the Fifth District Court of Appeals.
The County has until Monday, December 5, 2022, to file its notice of appeal. Appealing the order, absent further action by the Circuit Court, will not impact the effect of the injunction during the pendency of the appeal.
