Orange County Moves Up Transportation and School Impact Fee Rate Increases to June 2021, Adopts Higher Transportation Rates
On March 23, 2021, Orange County approved two ordinances amending County Code relating to school and transportation impact fees. The ordinances revised two previous ordinances approved by the Orange County Board of County Commissioners in 2020 that would have implemented increases to transportation and school impact fees in phases. Under the new ordinances, the full impact fee rate increases for transportation and schools will now become effective on June 27, 2021.
Additionally, where the 2020 transportation impact fee (TIF) ordinance adopted impact fees identified in the County’s Transportation Study at a “policy discount” factor rate of 75%, the new TIF ordinance revised the TIF schedule to reflect the study rates at 100%. As a result, the full increase in TIF rates will become effective more than a year ahead of the previously adopted 2020 schedule and will be significantly higher than the rates approved in 2020.
Current school impact fee rates, which were scheduled to partially increase on April 2, 2021, will now remain in place until June 27, 2021, when the full rate increase will become effective.
