Rachel Gebaide Talks to the Orlando Business Journal about Employee Vaccinations
Shareholder Rachel Gebaide recently talked to the Orlando Business Journal about employers and COVID-19 vaccinations, including whether employers can require employees to be vaccinated and what exceptions exists.
"Most private employers can require most of their employees to be vaccinated against COVID-19 as a condition of employment or continued employment. Employers who are parties to an employment agreement with a given employee or to a collective bargaining agreement with a union that sets forth the terms and conditions of employment for all or a portion of its workforce may not have the flexibility to require vaccination without amending the applicable agreement," said Gebaide. "Also, most employers may not be able to require every 'at-will' employee to be vaccinated if an accommodation is required by law in respect of the employee’s disability or sincerely held religious belief."
