Overview
Renewable energy is the fastest-growing energy source in the United States, sparking an explosion of innovation and entrepreneurship in the industry. Florida’s abundant sunshine makes it one of the top states for solar energy production. Lowndes’ Renewable Energy group was created to advise clients on the evolving legal and business issues of this emerging energy sector.
To help our clients successfully navigate the many challenges that often arise with renewable energy projects, our interdisciplinary team of seasoned attorneys represent clients in multiple areas affecting renewable energy projects: real estate, construction, land use, environmental, corporate, tax, and economic development.
We partner closely with our clients to find innovative strategies that take advantage of available benefits and opportunities and maximize profits within this rapidly expanding industry.
Real Estate & Construction
Synonymous with real estate law for more than 50 years, our firm has regularly represented developers, investors and other parties in the financing, acquisition, construction and leasing or sale of a wide variety of complex development projects, including acquisition or leasing of properties for utility-scale solar facilities and related battery storage.
Our real estate attorneys also regularly collaborate with attorneys in other practice areas, including tax, construction, financing and land use, to provide comprehensive services that ensure our clients’ individual needs are met.
Additionally, we have experience handling “green” projects, having assisted clients with the preparation and negotiation of sustainable design and construction agreements on LEED projects.
Land Use & Environmental
Our attorneys are very familiar with state and local government development regulations and land use laws in Florida. From project conception to completion, we work closely with project consultants, local government staff, and local public officials to help our clients successfully navigate through the complex web of land use and environmental regulations.
With a proven track record of handling high-profile and sometimes highly controversial projects, our attorneys frequently assist with land use due diligence review, represent clients in hearings – almost daily – before municipal, county or state governing or regulatory agencies, and obtain and review necessary permits and entitlements.
Corporate
Lowndes’ corporate attorneys regularly work with a wide range of clients, ranging from emerging companies to established businesses, on numerous business and legal matters, such as corporate governance, commercial contracts, licensing agreements, project finance, mergers and acquisitions, and governmental rebates and credits.
By understanding our clients’ critical needs and business objectives, we are able to deliver creative solutions that achieve overall strategic goals.
Property Tax Appeals
Lowndes’ attorneys have provided representation for nearly all types of property owners throughout the state, working to strategically minimize their property tax liability. We assist clients with review of assessments and exemption applications under various laws and regulations, and ultimately direct negotiations with county property appraisers, and handle tax appeal lawsuits and administrative appeals to the local Value Adjustment Board.
Tax
Our tax attorneys counsel clients on effectively utilizing federal and state incentive programs designed to encourage development of renewable energy projects. Additionally, our tax attorneys work closely with other attorneys in the firm, taking a lead role in the tax planning for and structuring of joint ventures, partnerships, mergers, acquisitions, reorganizations, divestitures, like-kind exchanges and real estate transactions, and other business ventures.
